You must complete the process for getting licensed in the US before starting the job application process.

State Boards of Nursing require that you first apply to CGFNS International, Inc. (National Council Licens to have your academic and professional credentials evaluated to ensure that your documents are authentic and that what you’ve learned is comparable to U.S. nursing standards. You may also be required to take the CGFNS Qualifying Exam® to satisfy State Board requirements, to satisfy immigration requirements for obtaining an occupational visa, and to determine your readiness for a licensure exam.

• U.S. law requires nurses to complete a screening program before they can receive an occupational
  visa
• CGFNS is approved by the U.S. Department of Homeland Security to validate the credentials of nine
  foreign healthcare professions for occupational visas, including registered nurses.
• Completing CGFNS’ VisaScreen®: Visa Credentials Assessment Service will satisfy the
  screening program requirement.

Nurses from foreign countries must meet one of two licensing/certificate requirements.

1. Possession of license in the state of intended employment in the U.S or

2. Successful completion of the Commission on Graduates of Foreign Nursing Schools (CGFNS) certification program. In the United States, each individual state requires you to obtain a license to practice nursing. Your first step should be deciding which of the 50 states you wish to work in. Since each state has different requirements to take the licensing exam, learn what qualifications you’ll need. You can find out more by contacting the National Council of State  Boards of Nursing for that state.

Instead of directly pursing state licensure, a nurse can complete the CGFNS certification program.

The CGFNS certification program consists of three parts:

1) a review of foreign nursing credentials

2) the CGFNS qualifying exam (offered in all the 50 states in the US and worldwide

3) an English language proficiency component . CGFNS accepts qualifying results from three standard English language proficiency examinations known as TOEL, TOEIC and IELTS.

The exams are administered by the Education Testing Service (ETS), The Chauncey Group, and a consortium of the Cambridge ESOL Examinations, the British Council and IDP Education Australia. Native-English speaking applicants who received their nursing education in Australia, Canada (except Quebec) Ireland, New Zealand or the United Kingdom may be exempted from the English Language requirement

Be aware that you must have passed all U.S. licensing exams for your profession within the state(s) you wish to work before applying for a visa. First, we will need to get labor certification approval from the U.S. Department of Labor for you. This is a long process. CNA do need labor certification. But RN and LPN do not need labor certification. We’ll then need to file what is known as the Immigrant Petition for Alien Worker, Form I-140 with the U.S. Citizenship and Immigration Services (USCIS).

We most likely will file the Form I-140 that designates you as what is known as “Employment Third Preference (E3): Skilled Workers, Professionals, and Unskilled Workers (Other Workers).” Once the USCIS approves our petition, they send it to the National Visa Center (NVC). The NVC then assigns a case number to our petition. You – or your attorney – will then receive a “fee bill” that asks for payment in advance of all government processing fees for you. Once you pay the fees, the NVC will forward your packet to you or your attorney that contains
biographical information forms that you’ll need to complete, as well as a list of documents you’ll need to submit.

Once you’ve submitted the forms, the NVC will schedule an appointment for an Immigrant Visa for you at the U.S. Consulate or Embassy in your country. Applying for a visa here in the United States can take weeks or months. We’ll help you here from our end as much as we can, but the responsibility for applying for and working your way through the visa process in your country is yours, not ours. You should research the process thoroughly.

For those candidates already lawfully present in the United States in an appropriate non immigrant visa status, an Adjustment of Status application (I-485) for the nurse and family members may be filed simultaneously with the immigrant petition.

The nurse may be authorized to accept employment with the healthcare institution immediately upon approval of the employment authorization component of the Adjusted of Status track (three to four months after filing) assuming there are no state license  issues

In order to be eligible for the Adjustment of Status track, the individual must have been lawfully admitted to the United States in s non immigrant classification that does not require non immigrant intent. Furthermore, the I-40 immigrant petition must be filed before the expiration of the period of authorized U.S stay, and the individual must not have been employed without authorization.
